Terms of Use

These definitions apply to these Terms and to every document that refers to them (Privacy Policy, Cookie Policy, Copyright Notice).

• "The Operator" ("we", "us") — Yaroslav Boruk (MAN1K), Ukraine, [email protected].
• "The Services" — man1k.xyz, its subdomains, and the email, SMS and other communication channels operated by the Operator. The merch store (Section 04) is excluded.
• "You" / "User" — any person who accesses the Services or whose contact data is held by the Operator.
• "Content" — all code, text, images, audio, artwork, design and other materials made available through the Services.
• "Controller" — the party that determines the purposes and means of processing personal data (Art. 4(7) GDPR); for the Services, the Operator.
• "Processor" — a third party that processes personal data on the Operator's behalf (Art. 4(8) GDPR).

By accessing or using the Services you agree to these Terms and to the documents listed in Section 00. The website is free of charge, with no user accounts and no payment processing. If you do not agree, stop using the Services.

• Editorial, journalistic and press coverage of MAN1K
• Sharing links to the Services
• Archival crawling by the Internet Archive
• Search indexing of publicly accessible pages

Without the Operator's prior written permission you may not:

• Use Content commercially or redistribute it publicly
• Create derivative works or use the site as a template for any public or commercial project
• Use the names "MAN1K" or "Yaroslav Boruk" for promotion, or impersonate MAN1K
• Use graphics, visuals, source code, music or audio for AI/ML training or datasets
• Scrape, bulk-download or harvest Content (including to build datasets, databases or competing resources), except as permitted in Section 02
• Interfere with the Services — degrade performance, bypass rate limits, manipulate the game, or inject malicious code

Any violation automatically terminates all rights granted under these Terms. The Operator may apply technical measures, including rate limiting, to protect the Services.

The Services embed or link to third-party platforms (e.g. Bandsintown, SoundCloud, YouTube, Bandcamp, Spotify) governed by their own terms. The Operator is not responsible for their content, availability or practices.

The merch store at shop.man1k.xyz is operated by Fourthwall; purchases, returns and disputes are governed exclusively by its Terms of Service, Privacy Policy and Returns Policy.

The Operator may add, change, replace or discontinue marketing and communication channels (email, SMS, messengers or others) and the providers behind them at any time, without requesting your consent again, to the extent permitted by applicable law. You can opt out of any channel as described in the Privacy Policy.

The Services are provided "AS IS", without warranty of any kind, express or implied. To the maximum extent permitted by law, the Operator is not liable for any claim, damages or other liability arising from or in connection with the Services or their Content.

Requests for any use not expressly permitted: [email protected]. Permissions are valid only when confirmed in writing.

The Operator may modify these Terms and any document referring to them at any time, without prior notice. Changes take effect on publication. Continued use of the Services after publication constitutes acceptance. Only the version currently published at man1k.xyz/legal/terms is in force.

If any provision is unenforceable, it is limited to the minimum extent necessary or severed; the rest remains in force. These Terms, together with the documents listed in Section 00 and, where applicable, the store terms, constitute the entire agreement between you and the Operator regarding the Services.
